These terms govern your use of Popov and the other services operated by Jackal AI at thejackal.ai and its subdomains (the "Service"). By creating an account or connecting a mailbox, you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.
Popov is an AI sales assistant. With your authorisation it sends outreach and follow-up messages from your own email address, reads replies to those conversations, proposes meeting times from your calendar availability, and maintains a record of your contacts and conversations. Where enabled, it also places calls and sends WhatsApp messages.
Connecting Google, Twilio, or WhatsApp is optional and revocable at any time. You confirm you are the authorised owner of any account you connect. Your use of those services remains governed by their own terms, and we are not responsible for their availability or actions.
You agree that you will not use the Service to:
You are the sender of every message the Service transmits on your behalf and remain responsible for its content and for compliance with the laws of your recipients' jurisdictions.
Popov drafts messages automatically and may produce inaccurate or inappropriate output. You are responsible for reviewing and configuring what it sends. We provide controls to require approval before sending; use of automatic sending is at your own risk.
You retain ownership of the content you provide and of the messages the Service handles for you. You grant us a limited licence to process that content solely to provide the Service. Our handling of personal data, including Google user data, is described in our Privacy Policy, which forms part of these terms.
Paid plans are billed in advance at the rates shown when you subscribe. Fees are non-refundable except where required by law. We will give at least 30 days' notice before a price change takes effect.
We aim for continuous availability but do not guarantee it. The Service depends on third-party providers and may be interrupted for maintenance, outages, or changes to those providers' APIs.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these terms, if your use creates legal or security risk, or if required by a provider such as Google. On termination we delete your data as described in the Privacy Policy.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any commercial outcome, deliverability rate, or response rate.
To the maximum extent permitted by law, Jackal AI is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing.
You agree to indemnify Jackal AI against claims arising from your content, your contact data, your use of the Service, or your breach of these terms or of applicable law.
We may update these terms. Material changes will be notified by email or in the product at least 14 days before they take effect. Continued use after that constitutes acceptance.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The courts located in Delaware have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
